BERENBAUM WEINSHIENK's Intellectual Property practice focuses on the protection, enhancement and enforcement of intellectual property (IP) rights. The Intellectual Property Practice Group counsels a wide variety of clients ranging from individuals and small start-up or non-profit entities to large national and multi-national corporations and research institutions such as universities. The IP protection areas for which we provide service include:

  • Patentability, freedom to operate and infringement and validity analysis and opinions;
  • Preparation and prosecution of trademark applications;
  • Preparation and prosecution of patents in all technology areas;
  • Protection of trade secrets;
  • Registration of copyrights;
  • Licensing of or otherwise transferring intellectual property, including technology transfer;
  • Performing IP due diligence in support of mergers and acquisitions or other transactions including IP;
  • Litigation concerning trademark and trade dress infringement, misappropriation of trade secrets, unfair competition, and patent infringement.

  • Biotechnology, including pharmaceuticals, diagnostics and biofuels;
  • Medical, dental and other health-related technologies including devices and pharmaceuticals;

Our practice is diverse nationally and internationally with clients throughout the United States and in a number of other countries. We also have close associations with counsel located in other U.S. states as well as in other countries, to bring world-wide protection to our clients.

The principal attorneys in the Intellectual Property Group are: K Kalan and Gary R. Maze.  Both attorneys are registered to practice before the U.S. Patent and Trademark office. Ms. Kalan is licensed in Colorado and California, and Mr. Maze in Texas.

Because intellectual property issues often interrelate with other aspects of a client’s business, the Intellectual Property Practice Group provides integrated legal services drawing on the experience and resources of our transactional, M&A, VC, securities, tax, employment, and litigation practice groups to provide our clients with the most appropriate legal and business advice to achieve the best results in each case.
